What's a Racking Permit in Ontario, Anyway?

If you manage a warehouse in Ontario, you’ve likely installed or reconfigured pallet racking at some point. But did you know that, with recent Ontario Building code 2024 that came into effect in 2025 many of those installations require a building permit?

A racking permit is not just red tape — it’s a legally mandated process to ensure structural and fire safety compliance. And failing to obtain one can lead to stop-work orders, fines, or even forced removal of racks. This post outlines when a racking permit is required, who’s responsible, and what documentation you need — with references from Ontario’s Building Code, OHSA, and municipal guidelines.

When Is a Racking Permit Required?

According to the Ontario Building Code (O. Reg. 332/12), a building permit is required for the construction or alteration of any building or structure (Government of Ontario, 2023a). Importantly, the OBC now classifies “shelf and rack storage systems” as self-contained structural systems — meaning pallet racking systems fall squarely under these requirements (Government of Ontario, 2023a, Part 3.16.1).

So when is a permit required?

Any new racking system that’s anchored to the building or exceeds minor heights
Any major reconfiguration (e.g., increasing rack height, changing layout)
Any rack-supported mezzanines or platforms

In most municipalities (e.g., Toronto, Oakville, Brampton), these installations are treated as building alterations requiring a permit.

The latest updates to the OBC also include fire protection requirements tied to commodity classifications (e.g., Class I–IV, Group A plastics), further reinforcing the need for permits where fire load or sprinkler design is impacted (Government of Ontario, 2023a, Section 3.16.3).

Who Is Responsible?

The Ontario Building Code Act stipulates that no person shall construct or alter a building without a permit, and owners must not allow construction to proceed without one. In a warehouse context, the property owner (landlord) is on the hook if work is done without a permit. If you are a tenant or warehouse operator, your lease may require you to take on permitting for any interior alterations.  Municipalities requires written authorization from the owner for tenants to submit applications

What’s Required in the Permit Application?

Municipalities across Ontario typically require the following documents. These items ensure your installation is structurally sound, fire-safe, and legally compliant.

1. Structural Drawings by a P.Eng.

Stamped drawings prepared by a Professional Engineer (P.Eng.) must show:

Rack layout and elevations
Anchor and baseplate details
Load capacities per level and bay
Seismic design (required under OBC since 2024)

These ensure the racking complies with OBC structural requirements (Government of Ontario, 2023a, Div. B, Part 4.1.8).

2. Floor Slab Capacity Letter

A letter or report from a structural engineer confirming the building’s concrete floor can support the loads imposed by the loaded racks. High-density storage can introduce heavy point loads through the rack uprights. (City of Burlington, 2023a). This letter typically accounts for rack leg loads and compares them against the slab’s design capacity or a recent assessment. If the slab is inadequate, reinforcement or other solutions may be needed before proceeding. Without this, point load failures can lead to dangerous collapses.

3. Sprinkler Design / Fire Protection Letter

Installing tall racks or storing new categories of goods can impact fire safety – for example, tighter rack aisles or higher storage can challenge the existing sprinkler system. A fire protection engineer or certified sprinkler contractor must confirm the racking:

Doesn’t obstruct fire suppression
Complies with NFPA 13 or CSA standards
Matches the commodity classification of stored goods
If in-rack sprinklers or other enhancements are required, those should be detailed.

This is essential for life safety and fire code compliance (City of Oakville, 2024).

4. Letter of Intended Storage & Commodity Classifications

This document identifies the types of materials to be stored, including:

Commodity class (e.g., Class I–IV, Group A plastics)
Packaging material (e.g., corrugated cardboard, shrink wrap)
Storage method (palletized, solid shelf, etc.)

This helps determine fire protection needs and ensures compliance with Ontario Fire Code and NFPA 13 design standards (MMAH, 2023). Municipalities such as Mississauga and Brampton explicitly require this as part of racking permit submissions

5. Engineer-Sealed Site Plan Including OBC Data Matrix

An engineer-sealed or architect-sealed site plan is a standard requirement for racking permit applications in many Ontario municipalities — not just Mississauga. This plan must show the overall building location on the property and key zoning and safety elements such as:

Building footprint
Lot lines
Adjacent properties and public roads
Parking areas and landscaping zones
Access routes for firefighting
Fire hydrant locations and emergency egress routes (where applicable)

In addition to this, most jurisdictions require an Ontario Building Code (OBC) Data Matrix on the drawings. (City of Oakville, 2024).

6. Electrical Letter

An electrical engineer (P.Eng.) letter indicating location of emergency lights and exit signage. It is ideal to submit a plan view drawing including the racking showing where the emergency and exit signage is located in relation to the racking

Confirming that lighting levels remain sufficient
Exit signs and fire alarms are still visible and code-compliant after the racks are installed.

7. Life Safety / Egress Plan

Must show:

Aisle widths and egress paths
Exit signage and emergency lighting
Fire-rated separations (if required)
This ensures that OBC Part 3 fire and egress provisions are maintained (Government of Ontario, 2023a). This ensures that even after racking installation, workers can safely evacuate in an emergency.

8. Commitment to General Review (P.Eng.)

The structural and fire engineers must complete this form, promising to:

Conduct field reviews during installation
Provide sign-off letters at completion

This is a legal requirement under Division C, Section 1.2 of the OBC (Government of Ontario, 2023a).

9. Final Inspection

Once the racking is installed:

Municipal inspectors verify the racks match approved drawings
Engineer’s general review letters must be submitted
Sprinkler and fire systems are inspected (if applicable)

Municipalities must respond within 2 business days for final inspections under Ontario’s building regulations (Government of Ontario, 2023b).

10. Permit Fees

Fees vary by city. Most use a rate per square meter:

Municipalities often use a service index rate per square meter of rack area.
Some cities may charge a flat fee.
Some cities may also assess development charges for rack-supported platforms (City of Oakville, 2024)

What’s the Approval Process?

While obtaining engineering documents like structural drawings or a PSR can usually be completed within a few weeks, the most common source of delay in the racking permit process is not the technical paperwork — it’s the lack of building-related information, particularly in older or previously modified facilities.

To avoid unexpected delays and cost overruns, applicants should consider the following at the initial planning stage:

1. Verify Existing Building Information

In older warehouses, original structural drawings, floor slab specifications, or geo-technical reports may be missing or incomplete. These documents are critical for a structural engineer to confirm that the slab can support the intended point loads from the racking. If unavailable, you may need to engage a geotechnical engineer to perform core sampling or slab testing — which can add weeks or even months to your timeline (City of Burlington, 2023; City of Oakville, 2024).

2. Engage a Sprinkler Contractor Early

One of the most overlooked (and expensive) aspects of racking projects is fire protection. The type and height of stored products can significantly affect the required sprinkler density, layout, and even type. Before submitting your permit application, consult a certified sprinkler contractor to:

Confirm whether the existing system can accommodate the new racking layout
Determine if in-rack sprinklers will be needed for your commodity classification
Avoid last-minute retrofits that could cost thousands and delay occupancy

According to NFPA 13 and the Ontario Building Code, Group A plastics, rubber tires, or combustible liquids in high storage configurations may trigger enhanced fire protection requirements (Government of Ontario, 2023; NFPA, 2022).

3. Don’t Underestimate Documentation Timelines

Even if your engineers work quickly, delays often come from:

Waiting on floor plans or slab data from the landlord
Fire protection documentation not matching commodity details
Unknown electrical or egress constraints only discovered during review

These issues are especially common in leased spaces or repurposed industrial units where record-keeping has been inconsistent. As a result, even a routine permit — which might be approved in 4 to 6 weeks under Ontario Building Code review standards (Government of Ontario, 2023b) — can extend to 3–4 months or longer when these foundational documents are missing. These delays can translate into real financial costs, including:

Idle labor and project management fees
Delayed product storage or distribution
Contractual penalties in tenant-landlord agreements
